The United States Citizenship and Immigration Service has extended Temporary Protected Status (TPS) for eligible nationals of El Salvador for an additional 18 months, beginning March 10, 2012 and ending Sept. 9, 2013.

Current Salvadoran TPS beneficiaries seeking to extend their TPS status must re-register during the 60-day re-registration period that runs through March 12, 2012. USCIS will accept applications filed January 9, 2012 through March 12, 2012.

The 18-month extension also allows TPS re-registrants to apply for a new Employment Authorization Document (EAD). Eligible Salvadoran TPS beneficiaries who re-register on time will receive a new EAD with an expiration date of Sept. 9, 2013. USCIS recognizes that all re-registrants may not receive their new EADs until after their current EADs expire. Therefore, USCIS is extending the current TPS El Salvador EAD bearing a March 9, 2012, expiration date for an additional six months, through Sept. 9, 2012.

To re-register, current TPS beneficiaries must submit an Application for Temporary Protected Status, Form I-821. TPS re-registrants must also submit an Application for Employment Authorization, Form I-765, regardless of whether they are applying for an EAD. Re-registrants do not need to pay the Form I-821 application fee, but they must submit the biometric services fee, or a fee waiver request, if they are age 14 or older. TPS re-registrants applying for an EAD must submit the Form I-765 application fee, or a fee waiver request.

Additional information on TPS for El Salvador, including guidance on the application process and eligibility, is available online at http://www.uscis.gov/tps.

U.S. Citizenship and Immigration Services (USCIS) announced its intention to automatically extend employment authorization for Liberian nationals covered under Deferred Enforced Departure (DED) through March 31, 2012. USCIS’s announcement follows President Obama’s announcement of his decision to extend DED through March 31, 2013, for qualified Liberians and those persons without nationality who last habitually resided in Liberia. The six-month automatic extension of existing Employment Authorization Documents (EADs) will permit eligible Liberians to continue working while they file their applications for new EADs. The new EADs will cover the full 18 months of the DED extension.

Certain individuals are not eligible for DED, including:

Liberians who did not have Temporary Protected Status (TPS) on Sept. 30, 2007 and are therefore not covered under current DED;

Certain criminals (e.g. aggravated felons and persons convicted of two misdemeanors);

Persons subject to the mandatory bars to TPS; and

Other ineligible persons as described in the President’s memorandum.

In addition to automatically extending the validity of EADs for Liberian nationals covered under DED, USCIS will publish a notice in the Federal Register with instructions for these individuals on how to obtain employment authorization for the remainder of the DED extension. Liberian nationals covered under DED will also need to include the Application for Employment Authorization, I-765, and a filing fee of $380, or a fee waiver request.

U.S. Citizenship and Immigration Services (USCIS) reminds eligible nationals of Haiti (and persons without nationality who last habitually resided in Haiti) to file for Temporary Protected Status (TPS).

TPS was originally designated for Haiti in January 2010 in response to a catastrophic earthquake that devastated that country. The current 18-month extension of TPS for Haiti will remain in effect through Jan. 22, 2013. The following three groups are covered under the Haiti TPS extension and re-designation:

Individuals filing for the first time: Individuals who do not currently have TPS may apply through Nov. 15, 2011.

Individuals with pending TPS applications: Individuals who applied for TPS under the initial designation announcement in January 2010 and whose applications were still pending as of May 19, 2011, will not need to file a new Form I-821, Application for Temporary Protected Status. Some individuals seeking to work should read the Federal Register notice (76 FR 2900) published on May 19, 2011, to determine if they need to file a new Form I-765, Application for Employment Authorization, to extend or request an Employment Authorization Document (EAD).

Individuals re-registering for TPS: Individuals who were initially granted TPS for Haiti through July 22, 2011 and who plan to remain in the United States., must re-register no later than Aug. 22, 2011. These individuals may still be authorized to work under the auto-extension of EADs through Jan. 22, 2012, as described in the Federal Register published on May 23, 2011 (76 FR 29777). Failure to file a TPS re-registration application before the deadline, without good cause, will result in withdrawal of TPS benefits, including employment authorization and protection from removal from the United States.

Unless TPS was denied or withdrawn before the expiration date of July 22, 2011, individuals holding a TPS-related EAD with that expiration date may still be authorized to work. These EADs have been automatically extended through Jan. 22, 2012.

These auto-extended EADs have “A12” or “C19” listed under “category” on the front of the card.

Haiti TPS beneficiaries are reminded to provide both the EAD with the July 22, 2011 date and a copy of the Federal Register notice to employers when proving proof of employment eligibility. For further guidance for Haiti TPS employers and employees, please refer to the USCIS Web page, Documentation Employers May Accept and Temporary Protected Status Beneficiaries May Present as Evidence of Employment Eligibility.

U.S. Citizenship and Immigration Services (USCIS) announced that some existing Salvadoran Temporary Protected Status (TPS) beneficiaries will receive interim Employment Authorization Documents (EADs) during the continued processing of their re-registration applications. USCIS mailed approximately 4,500 EADs, to be delivered no later than March 9, 2011, to Salvadorans who have not yet received a final action on their re-registration applications.

Issuance of the interim EADs will allow TPS beneficiaries to continue working while USCIS completes the processing of their re-registration applications. The original expiration date for Salvadoran EADs was Sept. 9, 2010. USCIS automatically extended this validity period to March 9, 2011.

Any re-registration applicant who receives an interim EAD must still respond to any USCIS requests for additional evidence, including requests for documents, or biometric or fingerprint appointments. Applicants can check the status of their cases by visiting the USCIS website at www.uscis.gov.

U.S. Citizenship and Immigration Services (USCIS) announced that the Department of Homeland Security (DHS) will extend Temporary Protected Status (TPS) for eligible nationals of Somalia from the current expiration of March 17, 2011 through the new expiration date of Sept. 17, 2012.

Under the extension, individuals who have been granted TPS are eligible to re-register and maintain their status for an additional 18 months. There are approximately 300 nationals of Somalia (and people having no nationality who last habitually resided in Somalia) who may be eligible for re-registration. TPS does not apply to Somali nationals who first entered the United States after Sept. 4, 2001.

To maintain TPS status, Somali TPS beneficiaries must re-register during the re-registration period from Nov. 2, 2010, until Jan. 3, 2011. USCIS will not accept applications from Somali TPS beneficiaries before Nov. 2, 2010.

USCIS will issue a new Employment Authorization Document (EAD) to eligible TPS beneficiaries who timely re-register and apply for EADs…

TPS beneficiaries must submit an Application for Temporary Protected Status (Form I-821) to re-register. Applicants seeking an extension of employment authorization must file an Application for Employment Authorization (Form I-765) with the required fee. If an individual does not want employment authorization, the applicant must still file Form I-765 for data-gathering purposes; the filing fee is not required. Re-registrants age 14 and older must submit the biometric fee. Applicants who are able to demonstrate an inability to pay may request a fee waiver for the application, biometric service fees or both. Failure to submit the required application and biometric fees or a properly documented fee waiver request will result in the rejection of the re-registration application. For information on fee waivers, visit the Fee Waiver Guidance Web page at www.uscis.gov.

U.S. Citizenship and Immigration Services (USCIS) announced that it will extend Temporary Protected Status (TPS) for nationals of Nicaragua from the current expiration of Jul. 5, 2010 to the new expiration date of Jan. 5, 2012.

Under the extension, individuals who have been granted TPS are eligible to re-register and maintain their status for an additional 18 months provided they remain otherwise eligible for TPS. TPS does not apply to Nicaraguan nationals who entered the United States after Dec. 30, 1998.

To maintain TPS status, Nicaraguan TPS beneficiaries must re-register during the re-registration period from May 5 until July 6, 2010. It is important to re-register as soon as the re-registration period opens to allow sufficient time for USCIS to complete all the routine background checks and further application processing. Applications from Nicaraguan TPS beneficiaries will not be accepted before May 5, 2010.

USCIS will issue a new Employment Authorization Document (EAD) to eligible TPS beneficiaries who timely re-register and apply for EADs. However, USCIS will automatically extend the validity of existing EADs held by Nicaraguan TPS beneficiaries until Jan. 5, 2011.

TPS beneficiaries must submit Form I-821, Application for Temporary Protected Status, to re-register. Applicants seeking an extension of employment authorization must file Form I-765, Application for Employment Authorization, with the required fee. If an individual is only seeking to re-register for TPS, the applicant must still file Form I-765 for data-gathering purposes; the filing fee is not required. Re-registrants age 14 and older must submit the biometric fee.

Under the extension, individuals who have been granted TPS are eligible to re-register and maintain their status for an additional 18 months provided they remain otherwise eligible for TPS. There are approximately 66,000 nationals of Honduras (and people having no nationality who last habitually resided in Honduras) who may be eligible for re-registration. TPS does not apply to Honduran nationals who entered the United States after Dec. 30, 1998.

To maintain TPS status, Honduran TPS beneficiaries must re-register during the re-registration period from May 5 until July 5, 2010. It is important to re-register as soon as the re-registration period opens to allow sufficient time for USCIS to complete all the routine background checks and further application processing. Applications from Honduran TPS beneficiaries will not be accepted before May 5, 2010.

This automatic extension will allow sufficient time for eligible TPS beneficiaries to re-register and receive new EADs without any lapse in employment authorization.

TPS beneficiaries must submit Form I-821, Application for Temporary Protected Status, to re-register. Applicants seeking an extension of employment authorization must file an Application for Employment Authorization, Form I-765, with the required fee. If an individual is only seeking to re-register for TPS, the applicant must still file Form I-765 for data-gathering purposes; the filing fee is not required. Re-registrants age 14 and older must submit the biometric fee.

The USCIS issued a Question and Answer on the new TPS extension for Hondurans. To read this Q/A, please click here.

U.S. Citizenship and Immigration Services (USCIS) announced that it has automatically extended employment authorization for Liberian nationals covered under Deferred Enforced Departure (DED) through Sept. 30, 2010. DED has also been extended through Sept. 30, 2011 for qualified Liberians and those persons without nationality who last habitually resided in Liberia. The sixth-month automatic extension of existing Employment Authorization Documents (EADs) will permit eligible Liberians to continue working while they file their applications for new EADs that will cover the full twelve months of the DED extension.

Although DED was scheduled to end for Liberian nationals on March 31, 2010, President Obama determined that there are compelling foreign policy reasons to continue deferring enforced departure from the United States for eligible Liberian nationals presently living in the United States under the existing grant of DED for 18 additional months.

Certain individuals are ineligible for DED, including Liberians who did not have Temporary Protected Status on September 30, 2007 and are therefore not covered under current DED, certain criminals, persons subject to the mandatory bars to Temporary Protected Status, and persons whose removal is in the interest of the United States.

In addition to automatically extending the validity of employment authorization documents for Liberian nationals covered under DED, USCIS will publish a notice in the Federal Register with instructions for these individuals on how to obtain employment authorization for the remainder of the DED extension.

We urge Liberians and employers to read this excellent Q and A from the USCIS.
