North Carolina Passes E-Verify Law

Recently, North Carolina passed a new law that would make E-Verify, a Federal employment verification program, mandatory for all businesses.  Under the new law, cities, counties and businesses that employ 25 or more workers will have to use the electronic verification system.

The law will be phased in as follows:

  • October 2011 – cities and counties
  • October 2012 – companies with more than 500 employees
  • January 2013 – companies with 100 to 500 employees
  • July 2013 – companies with 25 to 100 employees

E-Verify is an Internet-based system operated by the U.S. Department of Homeland Security (DHS) in partnership with the Social Security Administration (SSA) that allows participating employers to electronically verify the employment eligibility of their newly hired employees and/or employees assigned to a covered Federal contract.  Employers who use E-Verify are still required to complete an I-9 form for each employee within three (3) days of hire.
