Practice Pointer: Converting from L-1B to L-1A StatusPosted by Murali Bashyam on Nov 4, 2009 in L1 Intracompany Transfers, News | 0 comments
The Vermont Service Center (VSC) recently issued a practice pointer on cases requesting a conversion from L-1B specialized knowledge to L-1A manager/executive status. Please note the following tips by the VSC:
- A $500 fraud fee is not required since the VSC considers this a change in the conditions of employment rather than a ‘change of status’.
- If you are requesting an extension of stay, Part 2.2 of Form I-129 should be checked ‘c’ – “change in previously approved employment. Also, Part 5 should be checked ’c’ – “extend the stay of the person(s) since they now hold this status.”
- If you are not requesting an extension of time, Part 2.2. of Form I-129 should checked ‘c’ and Part 5 should be checked ’d', which is “amend the stay of the person(s) since they now hold this status.”
We hope that you find this information helpful. Check back on our web site at www.bashyamspiro.com for additional practice pointers.
